It's hard to enforce a signed NDA because a condition of enforcement is having legal evidence (which can hold up in court) of breach of the contract by the bound party (the patient) -- i.e. evidence of a statement by the patient (testimony of a witness) and causation, i.e. proof that the patient's statement caused the plaintiff damages. In the US, most NDA's don't quantify damages as in Gho's contract which has a $3-4K "liquidated damages clause" written into it. But Gho would still have to be able to prove the patient's breach in court to collect on this, which means showing evidence that a statement was made to a third party and being able to trace that statement to the patient.
In the US, an NDA is worth only as much as a plaintiff is able to back it up by filing a lawsuit (or credibly threatening to file) if and when there is an unauthorized disclosure. Sometimes just the prospect of having to defend such a lawsuit (hiring a lawyer by the hour) is enough to keep people's mouths shut.
